GENERAL TERMS AND CONDITIONS
1. Use of Web shop
1.1. Placing an order at the web shop of Marileea Järnefelt Contemporary Art/MAJCA COLLECTION does not require registration. Marileea Järnefelt Contemporary Art collects only the required data to implement your order.
1.2. When using the web service or web shop you agree to:
1.2.1. Use the web service and web shop in accordance with these General Terms & Conditions;
1.2.2. Approve the General Terms & Conditions and the Privacy Policy of Marileea Järnefelt Contemporary Art/MAJCA COLLECTION:
Observe express diligence and caution when using the web shop
Provide truthful information about you as well to change this information when necessary
Obtain the consent of your guardian for your purchase if you are under 18 year’s old;
2. Validity of Order
2.1. You can easily place orders to our web shop 24 hours per day. Products are ordered by placing them in the shopping cart. Follow the instructions provided by the web shop in order to complete your order. The order confirmation page shows the aggregate payable amount inclusive all taxes and delivery costs.
2.2. A binding Contract of Sales becomes valid when Marileea Järnefelt Contemporary Art/MAJCA COLLECTION has sent you an order confirmation by email. Thereafter Marileea Järnefelt Contemporary Art/MAJCA COLLECTION does not have the right to change the terms applicable to your order.
2.3. Prior to its delivery, a consumer has the right to, partly or fully, cancel the order by email, letter or telephone. Delivery has taken place when the consumer has received the ordered products or a notification confirming that the ordered products can be collected.
2.4. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION and the customer keep contact either by using email (marileea.jarnefelt@marileeajarnefelt.com), letter (Marileea Järnefelt, Vetehisentie 13, 02400 Kirkkonummi, Finland), or telephone (+358 45 316 1004).
3. Prices
3.1. Prices displayed are inclusive of VAT but exclude delivery charges. The prices in our web shop are shown in euros (EUR).
3.2. Shipping to Finland is free of charge. To EU countries and other European countries the shipping price varies between EUR 14,90 - 29,00. Please look at Delivery costs and times.
3.5. Customers ordering products to be delivered outside the EU are, in addition to the postage fees provided in Section 3.2 above, are responsible for any customs or other government fees applicable to their order.
4. Terms of Delivery
4.1. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION delivers products currently to Finland and other EU countries as well as European countries outside EU.
4.2. Delivery times vary between different countries. Estimated time of delivery is 2-5 days within Finland and EU.
4.3. If you prefer, you may also collect the product from the showroom, Vetehisentie 13, 02400 Kirkkonummi.
4.4. In the event a product delivery is required per a certain date, such request must be informed in connection with the order. We will do our best to deliver accordingly.
4.5. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION is not responsible for any damages or delays which are due to force majeure or similar reasons beyond its control which it could not have reasonably predicted or the consequences of which could not be avoided. Force majeure and similar reasons consists of, but is not limited to the following: import and exports bans, industrial actions, sick leave of personnel, authority decisions, equipment or personnel related problems of cooperation ateliers, delays in fabric deliveries, disruptions in transportation, war, natural disasters, or any other similar reason. In the event the force majeure or similar reason continues for more than three months, both the consumer and Marileea Järnefelt Contemporary Art/MAJCA COLLECTION have the right to cancel the order/agreement without any damage or other consequences.
5. Payment Terms

5.1.1. Stripe acts as an implementer of the payment handling service and as a Payment Service Provider. Stripe will be shown as the recipient in the invoice and Stripe will forward the payment to the merchant. Stripe is an authorized Payment Institution.
5.1.2. Further instructions on how to complete the payment transaction can be found on our web shop.
6. Product Change and Return
6.1. It is important to us that you are satisfied with your order. If the product does not meet your expectations, you can, within 14 days from its receipt by mail, change it to another design of the same product category or return it by following the Product Return Instructions.
6.2. The Product Return Instructions provided below are applicable in EU countries (excluding Finland and Sweden which are subject to separate Product Return Instructions).
6.3. The Product Return Instructions are part of these General Terms and Conditions. Observe these Instructions as well the instructions received in connection with your product, in the event you wish to change or return your product.
6.4. Before returning the product, inform us about product returns and changes by either sending an email to marileea.jarnefelt@marileeajarnefelt.com or by telephone +358 45 316 1004. You are required to notify of product returns and changes by using the Product Return Form that we will send you by email. Print, fill and attach the completed Product Return Form to the postal package together with the returned products and follow, in addition to these instructions, any additional instructions received in connection with your product delivery.
6.5. In the event the product has been damaged during transportation, please observe carefully the Product Return Instructions.
7. Reclamation
7.1. After the receipt of the delivered package, it is the obligation of the customer to, without delay carefully inspect its contents, the condition and amount of the products.
7.2. In the event that a wrong product or a wrong amount of products have been delivered to you or in case your product is defective, please contact immediately us by either sending an email to marileea.jarnefelt@marileeajarnefelt.com or by telephone +358 45 316 1004.
7.3. The seller of the product is responsible for any defects in the product in accordance with applicable consumer protections laws. The 14-day time limit mentioned in Section 6.1 does not limit the right of customer to make claims on the basis of product defects.
7.4. A product is defective e.g. when it is torn or otherwise damaged. A product is not considered to be defective on the basis of normal wear and tear nor if the product has been damaged or has shrunk, because it has not been used and washed in accordance with given instructions.
7.5. A defective product should be returned in accordance with the Product Return Instructions. After the receipt of the said defective product Marileea Järnefelt Contemporary Art/MAJCA COLLECTION will either change the product or refund the price of the product.
9. Changes in Terms and Conditions
9.1. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION withholds the right to change its General Terms and Conditions as well as other terms and conditions applicable to its web shop, such as the Product Return Instructions, the Privacy Policy and its prices. It is the obligation of the customer to carefully familiarize oneself with applicable terms and conditions prior to making an order at the web shop.
10. Governing Law and Jurisdiction
The web shop of MAJCA COLLECTION as well as all related transactions and agreements are governed by the laws of Finland, unless mandatory consumer protection laws of some other country must be applied. All disputes will be resolved at the District Court of Helsinki.

1. Palvelun käyttö
1.1. Tilaaminen Marileea Järnefelt Contemporary Artin MAJCA COLLECTION -verkkokaupasta ei edellytä rekisteröitymistä. Marileea Järnefelt Contemporary Art kerää tilauksen yhteydessä tarpeelliset henkilötietosi tilauksen toteuttamiseksi.
1.2. Käyttämällä Marileea Järnefelt Contemporary Art verkkopalvelun MAJCA COLLECTION -kauppaa sitoudut:
1.2.1. käyttämään verkkopalvelua ja –kauppaa näiden yleisten ehtojen mukaisesti;
1.2.2. hyväksymään Marileea Järnefelt Contemporary Artin/MAJCA COLLECTIONIN yleiset ehdot ja tietosuojaperiaatteet:
noudattamaan erityistä huolellisuutta ja tarkkaavaisuutta verkkokauppaamme käyttäessäsi
antamaan itsestäsi todenmukaiset tiedot sekä muuttamaan tarvittaessa näitä tietoja
hankkimaan huoltajan suostumuksen tilauksellesi, mikäli olet alle 18-vuotias
2. Tilauksen sitovuus
2.1. Voit tilata tuotteita verkkokaupastamme mihin vuorokauden aikaan tahansa. Tuotteiden ostaminen tapahtuu lisäämällä haluamasi tuotteet ostoskoriin. Sen jälkeen seurataan verkkokaupan antamia ohjeita tilauksen loppuunsaattamiseksi. Tilauksen vahvistussivulta käy ilmi ostosten loppusumma, joka sisältää verot ja toimituskulut.
2.2. Sitova kauppasopimus tulee voimaan, kun Marileea Järnefelt Contemporary Art/MAJCA COLLECTION on lähettänyt sinulle sähköpostitse tilausvahvistuksen. Tämän jälkeen Marileea Järnefelt Contemporary Art/MAJCA COLLECTION voi pidättää oikeuden muuttaa kauppaan liittyviä ehtoja.
2.3. Sinulla on ennen tilauksen toimitusta oikeus sähköpostitse, kirjeitse tai puhelimitse peruuttaa tilaus osin tai kokonaan. Tilauksen toimitus on tapahtunut, kun tilauksen seurantatunnus on lähetetty sähköpostitse.
2.4. Yhteydenpito osapuolten välillä tapahtuu joko sähköpostitse, marileea.jarnefelt@marileeajarnefelt.com, kirjeitse tai soittamalla +358 45 316 1004.
3. Hinnat
3.1. MAJCA COLLECTION -verkkokaupan hinnat ovat euroissa (EUR) ja ne sisältävät arvonlisäveron.
3.2. Toimitukset Suomeen tapahtuvat ilman erillistä veloitusta. Muiden Euroopan maiden osalta kuljetuskulut vaihtelevat maakohtaisesti EUR 14,90-29,00 välillä. Katso lisää Toimituskulut ja -hinnat sivulta.
3.3. EU:n ulkopuolisten tilausten osalta huomioithan, että jos tilaat EU:n ulkopuolelle, vastaat ilmoittamiemme postituskulujen lisäksi mahdollisista tulli- tai muista viranomaismaksuista.
4. Toimitusehdot
4.1. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION toimittaa tuotteita tällä hetkellä Suomeen, muihin EU-maihin sekä EU:n ulkopuolisiin Euroopan maihin.
4.2. Tuotteiden arvioitu toimitusaika vaihtelee kohdemaittain, mutta on EU-alueella noin 2-5 arkipäivää.
4.3. Voit myös noutaa tuotteet showroomista postituksen sijaan, osoite: Vetehisentie 13, 02400 Kirkkonummi. Palautettaessa tuotteita showroomista noudetut tuotteet tulee myös palauttaa showroomiin.
4.4. Mikäli haluat tuotteen ehdottomasti tiettyyn päivään mennessä, on sinun mainittava siitä erikseen tilauksen teon yhteydessä. Pyrimme huomioimaan toiveesi, mikäli mahdollista.
4.5. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION ei vastaa vahingoista tai viivästyksistä, jotka johtuvat sen vaikutusmahdollisuuksien ulkopuolella olevasta ylivoimaisesta esteestä, jota se ei olisi voinut kohtuudella ennakoida tai jonka seurauksia se ei voi välttää. Tällaiseksi esteeksi katsotaan mm. tuonti- ja vientikiellot, työtaistelutoimenpide, henkilökunnan sairastuminen, viranomaisten päätökset, häiriöt kuljetuksissa, sota, luonnonmullistukset tai muu vastaava seikka. Mikäli ylivoimainen este jatkuu yli kolme kuukautta, on sekä sinulla että Marileea Järnefelt Contemporary Artilla/MAJCA COLLECTIONilla oikeus purkaa etämyyntisopimus ilman vahingonkorvaus- tai muita seuraamuksia.

5.1.1. Maksunvälityspalvelun toteuttajana ja maksupalveluntarjoajana toimii Stripe, joka näkyy maksun saajana tiliotteella tai korttilaskulla ja se välittää maksun kauppiaalle. Stripellä on maksulaitoksen toimilupa.

6. Tuotteen vaihto ja palauttaminen
6.1. Meille on tärkeää, että olet tyytyväinen tilaukseesi. Jos tuote ei vastaa odotuksiasi, voit vaihtaa tai palauttaa sen 14 päivän kuluessa tuotteen vastaanottamisesta. Tuotteidemme vaihto- ja palautusohjeet ovat osa näitä yleisiä ehtoja ja ne löytyvät asiakaspalautussivuiltamme. Noudata näitä ohjeita sekä tuotteen mukana tulleita ohjeita tarkasti, mikäli haluat vaihtaa tai palauttaa tuotteen. Hyvitämme palauttamasi tuotteen/tuotteiden alkuperäisen ostohinnan/hinnat. Tilauksen noutamatta jättäminen noutopisteestä ei ole sama asia kuin asiakaspalautus. Mikäli haluat peruuttaa tilauksesi sen jälkeen, kun se on jo lähetetty sinulle, nouda lähetys normaalisti ja palauta se meille asiakaspalautusohjeita noudattaen.
6.2. Mikäli tuote on vahingoittunut kuljetuksen aikana, noudata tarkoin asiakaspalautusohjeitamme.
7. Reklamaatio
7.1. Asiakkaan velvollisuus on tarkastaa saapuneen tilauksen sisältö, tuotteiden kunto ja vastaanotettu kappalemäärä huolellisesti heti, kun tilaus on vastaanotettu.
7.2. Jos sinulle on toimitettu väärä tuote, väärä määrä tuotteita tai tuotteessa on virhe, ole viipymättä yhteydessä sähköpostitse marileea.jarnefelt@marileeajarnefelt.com tai puhelimitse soittamalla numeroon +358 45 316 1004.
7.3. Vastaamme myymämme tuotteen virheestä kuluttajansuojalain 5. luvun mukaisesti. Edellä kohdassa 7.4 mainittu 14 päivän määräaika ei rajoita oikeuttasi tehdä reklamaatiota tuotteessa olevan virheen vuoksi.
7.5. Tuotteessamme on virhe esim. silloin, jos se on vastaanottaessa repeytynyt tai muutoin vahingoittunut. Tavaran virheenä ei pidetä tavaran luonnollista kulumista käytössä eikä myöskään sitä, jos tavara on vahingoittunut tai esim. kutistunut, koska sitä ei ole käytetty tai pesty antamiemme ohjeiden mukaisesti.
7.6. Palauta virheellinen tuote asiakaspalautusohjeen mukaisesti. Kun olemme vastaanottaneet palauttamasi tuotteen, vaihdamme sen joko uuteen tuotteeseen tai palautamme tuotteen hinnan.
9. Ehtojen muuttaminen
9.1. Marileea Järnefelt Contemporary Art/MAJCA COLLECTION pidättää oikeuden muuttaa yleisiä ehtojaan sekä muita verkkokaupassa sovellettavia ehtoja, kuten asiakaspalautus- ja tietosuojaehtojaan sekä hintojaan. Asiakkaan velvollisuus on ennen tilauksen tekoa tutustua kulloinkin voimassa oleviin ehtoihin.
10. Sovellettava laki ja riitojen ratkaisu
10.1. MAJCA COLLECTION -verkkokauppaan ja etämyyntisopimukseen sovelletaan Suomen lakia. Pyrimme ensisijaisesti ratkaisemaan mahdolliset erimielisyydet neuvottelemalla. Jos emme saa ratkaistua kauppasopimukseen liittyvää erimielisyyttä neuvottelemalla, sinulla on oikeus saattaa asia kuluttajariitalautakunnan ratkaistavaksi (www.kuluttajariita.fi). Ennen asian viemistä kuluttajariitalautakunnan käsittelyyn, sinun on oltava yhteydessä maistraattien kuluttajaneuvontaan (www.kuluttajaneuvonta.fi). Voit myös saattaa kauppasopimukseen liittyvän erimielisyyden ratkaistavaksi Euroopan komission ylläpitämän niin kutsutun verkkovälitteisen riidanratkaisun kautta (http://ec.europa.eu/odr).
